Here is a flow chart for Terminations of Transfers for Copyrights in Sound Recordings.
The chart is designed to provide a way to work through certain questions about terminations of transfer. For example, threshold questions can knock out the eligibility for termination, such as whether the sound recording is a work made for hire, or whether the grant was executed by will. It also provides information on the individuals (authors, widows/widowers, children and grandchildren, etc.) who are entitled to exercise termination and the amounts of interests required to effect transfer. Finally, it touches on the period during which termination can be effected.
The chart does not cover everything about termination of transfer; I believe this would be extremely difficult to do, and also make for a useless chart! For example, the chart does not cover certain mechanics of transfer, e.g., notice, filing, etc. Nor does it cover the effects of termination, e.g., derivative works, etc.
You may notice that termination under § 304(d) is not covered in this flow chart. This is because copyrights in sound recordings fixed prior to February 15, 1972 are not covered by federal copyright law (but may be covered under state/common law regimes). Since any sound recording first fixed between February 15, 1972 and December 31, 1977 would not be subsisting in its renewal term on the effective date of the Sonny Bono Copyright Term Extension Act (October 27, 1998), which is a prerequisite to the application of § 304(d), there is no need to address § 304(d) in this chart.
